PORT ANGELES — A Port Angeles man accused of staring at a teenage girl through her bedroom window while she slept last week was not charged Tuesday after a prosecuting attorney said more evidence was needed.
Spencer J. Silva, 21, was arrested Friday on investigation of residential burglary and voyeurism after a Carlsborg resident told authorities his daughter was awakened by a man looking through her window at about 2 a.m.
Silva was scheduled to be charged Tuesday. He was not charged.
“Basically, we need some additional evidence before we’re in a position to file charges,” Clallam County Deputy Prosecuting Attorney John Troberg said Tuesday.
“I did not dismiss the case because the case was never filed.”
Troberg was handling the matter for fellow Clallam County Deputy Prosecuting Attorney Ann Lundwall, who is in trial this week.
“The order exonerating the defendant from conditions of release does not prevent us for filing charges in the future,” Troberg said.
Troberg declined to speculate on whether charges will be filed.
No future court date was scheduled in a one-minute hearing Tuesday.
Silva was released from Clallam County jail Friday under the condition that he have no contact with the alleged victim, who is 17.
According to the arrest narrative, the alleged victim told deputies that she and Silva stared at each other for about 30 seconds before he ran away.
Silva was arrested a short time later about 100 yards from the residence.
He had wet grass clipping on his shoe, which matched impressions left near the residence, Clallam County sheriff’s deputies said.
