Arrest warrant issued for Sequim contractor

Complainants allege Gamboa failed to complete jobs after being paid

PORT ANGELES — An arrest warrant has been issued for a Sequim contractor after he failed to respond to a court summons for two counts of second-degree theft and one count of a contractor licensing laws violation, according to a news release from the Clallam County Prosecuting Attorney’s Office.

Tommy Dean Gamboa, 39, doing business as Beach Bros Fence LLC, was charged April 9 in Clallam County Superior Court. The warrant was issued Friday.

According to court records, Gamboa allegedly “did wrongfully obtain or exert unauthorized control of property of another” in the amounts of $1,620.78 in February 2022, $514.78 in March 2022 and $1,142.63 in December 2021.

Second-degree theft is a Class C felony, punishable by up to five years imprisonment and/or a $10,000 fine plus restitution and assessments.

Gamboa also allegedly “did advertise, offer to do work, submit a bid or perform any work without being registered as a contractor” in April 2022.

That is a violation of contractor licensing laws, which is a gross misdemeanor, punishable by up to 364 days imprisonment and/or a $5,000 fine plus restitution and assessments.

According to the probable cause statement, six complainants have filed reports with the state Department of Labor and Industries alleging Gamboa and/or his company contracted jobs and then failed to complete or even start them after receiving payment.

The statement filed in November 2022 stated a Labor and Industries investigator allegedly found that Gamboa and his company were not a registered contractor nor was the business an LLC company as required by state law.

Non-compliance infractions were issued with fines totaling $29,000.
