SEATTLE — A man who wants to be Clallam County’s next top criminal prosecutor was released from jail in King County today.
David R. Fox was released after the King County Prosecuting Attorney’s Office did not file charges within 72 hours after his arrest late Sunday evening at Seattle-Tacoma International Airport.
Fox, a Port Angeles attorney, is an announced candidate for Clallam County prosecuting attorney.
He has not filed as a candidate. Deadline to file at the Clallam County Courthouse in Port Angeles for the August primary — there are already three candidates who have filed — is Friday at 4:30 p.m.
Leesa Manion, chief of staff for King County Prosecuting Attorney Dan Satterberg, said in a voice-mail message that the office did not file charges Thursday because it is awaiting a toxicology report. She could not be reached for further comment.
Airport police arrested Fox for investigation of driving while intoxicated, possession of marijuana and drug paraphernalia, and possession of prescription drugs without a prescription.
The arrest came a few minutes after Fox, 49, allegedly displayed a sheathed knife to a ticket agent.
Airport police stopped his truck as it was leaving the check-in drive and determined that he was intoxicated.
Fewer than 40 grams of marijuana, a marijuana pipe and two prescription drugs were found in the truck, Port of Seattle police said.
The police probable-cause statement didn’t specify if he was under the influence of a drug or alcohol.
The arrest came two days after the state Attorney General’s Office said it would not file charges against Fox after investigating allegations of sexual misconduct with a former client and introduction of contraband into Clallam County jail.
