The sentencing of Spencer J. Silva was reset Tuesday to March 13 at 1:30 p.m. in Clallam County Superior Court.
The sentencing was reset because Ann Lundwall, the Clallam County deputy prosecutor handling the case, was unable to attend this week’s sentencing hearing and because a requested Department of Corrections pre-sentencing report had not been completed, Deputy Prosecuting Attorney John Troberg said.
Silva was found guilty of second-degree assault with a deadly weapon, first-degree attempted robbery and residential burglary Jan. 22.
He remains in the Clallam County jail on $300,000 bond.
As part of the pre-sentencing report, Troberg said corrections officers will interview witnesses, victims and others involved in the case to give the judge more information when sentencing Silva.
“[It’s intended] to give the judge a fuller picture of the case,” Troberg said.
Silva knocked a 22-year-old woman off her bicycle on the Olympic Discovery Trail just west of Railroad Ridge Park in Carlsborg the morning of July 21.
The woman fought off Silva, who was wearing a clown mask, by kicking and screaming until neighbors arrived and chased Silva off.
Clallam County sheriff’s investigators found a 7.5-inch knife at the scene and recovered Silva’s DNA from it, though the weapon was not used in the attack.
In a separate incident in August 2011, Silva reached into the window of a bedroom occupied by a 17-year-old Sequim and opening the blinds just before 2 a.m.
Silva, who said he was trying to steal the girl’s laptop to support his methamphetamine habit, was arrested a half-hour later when he returned to the same house.
Silva was found not guilty of voyeurism Jan. 22, and Clallam County Superior Court Judge S. Brooke Taylor dismissed sexually motivated enhancements that had been attached to other charges.
